2. Service Description

Love Album provides a web platform that enables users to:

• Create collaborative digital photo albums
• Share photos via QR code or direct link
• Manage album access (public, password-protected, or private)
• Collect and organize photos shared by guests

3. Access Conditions

3.1 Minimum Age

Use of the service is reserved for persons aged 16 or older. Minors aged 16 to 18 must obtain authorization from their legal representatives.

3.2 Registration

To create an account, you must:

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of your login credentials
• Immediately notify us of any unauthorized use
• Be responsible for all activities performed from your account

4. Acceptable Use

4.1 User Obligations

You agree to:

• Use the service in accordance with its intended purpose
• Respect third-party intellectual property rights
• Not publish illegal, defamatory, or rights-infringing content
• Not attempt to circumvent security measures
• Not use the service for commercial purposes without authorization

4.2 Prohibited Content

The following are strictly prohibited:

• Pornographic, violent, or discriminatory content
• Content infringing on others’ privacy
• Content violating copyright laws
• Content inciting hatred or violence

5. Intellectual Property

5.1 Platform Rights

The entire Love Album platform (software, design, trademarks) remains the exclusive property of Farid Rehila.

5.2 Your Content Rights

• You retain all rights to the photos you upload
• You grant Love Album a limited license for service provision
• This license expires upon account deletion

6. Data Protection

6.1 Hosting and Location

• Your data is hosted on servers located in Germany
• We comply with the General Data Protection Regulation (GDPR)
• Our privacy policy details data processing practices

6.2 Security

We implement appropriate technical and organizational measures to protect your data against unauthorized access, modification, disclosure, or destruction.

7. Pricing and Payments

7.1 Prices

• Prices are displayed in euros, all taxes included
• Applicable rates are those displayed on the site at the time of order
• For subscriptions, the displayed price is the amount billed at each billing period (monthly or annual)

7.2 Available Plans

Love Album offers several plans:

• One-time payment: a single purchase granting access to the service under the conditions provided at purchase, with no subscription or automatic renewal
• Monthly subscription: €4.99 per month, billed every month until cancelled
• Annual subscription: €49 per year, billed every year until cancelled

7.3 Payment Terms

• Payments are processed securely by Stripe
• Accepted payment methods are indicated during checkout
• For a one-time payment, the amount is due immediately
• For a subscription, the first charge occurs at sign-up, then at each billing period until cancelled

7.4 Automatic Renewal and Cancellation of Subscriptions

• Monthly and annual subscriptions renew automatically at each billing period unless cancelled beforehand
• You may cancel your subscription at any time, free of charge, online, directly from your personal space
• For the annual subscription, we will notify you by email before each renewal date, within the timeframe required by applicable regulations, of your option not to renew
• Cancellation takes effect at the end of the period already paid for: you retain access until that date, with no renewal beyond it
• Unless otherwise required by law, amounts already charged for the current period are not refunded on a pro-rata basis if you cancel during that period

7.5 Right of Withdrawal

The 30-day money-back guarantee applies subject to the conditions provided at purchase. It is additional to, and does not replace or limit, any mandatory withdrawal right that may apply. For a subscription, this right applies within the statutory period from the initial sign-up and does not restart at each automatic renewal. Early performance of a digital service may require your express agreement and acknowledgment of the loss of this right, under applicable law.

8. Liability

8.1 Love Album’s Liability

• We strive to provide quality service and optimal availability
• Our liability is limited to direct and foreseeable damages
• We do not guarantee the absence of interruptions or errors

8.2 User Liability

• You are solely responsible for content you publish
• You agree to indemnify Love Album against third-party claims
• You are responsible for backing up your data

9. Duration and Termination

9.1 Duration

• For a one-time payment, the contract covers the plan purchased, without subscription or automatic renewal
• For a subscription (monthly or annual), the contract is for an indefinite duration and renews automatically at each billing period until cancelled, under the conditions of section 7.4

Album retention, archiving and deletion are governed by our Privacy Policy, which forms an integral part of these Terms.

9.2 Termination by User

You may terminate your account or subscription at any time, free of charge, directly from your personal space, or by contacting us. For a subscription, termination takes effect at the end of the period already paid for, in accordance with section 7.4.

9.3 Termination by Love Album

We may suspend or terminate your access in case of:

• Violation of these terms
• Non-payment
• Prolonged inactivity (more than 24 months)
• Cessation of business

9.4 Effects of Termination

• The retention lifecycle is: active, notice sent to the owner, read-only, then final and irreversible deletion of the files and associated metadata, as described in our Privacy Policy
• Guests may upload an unlimited number of photos; free-plan viewing and download limits, and retention of locked photos, are described in that policy
• Immediate loss of service access
• The refund and withdrawal rules in section 7 continue to apply

10. Service Modifications

We reserve the right to modify, suspend, or discontinue all or part of the service, with 30 days’ notice for substantial modifications.

11. Force Majeure

We shall not be held responsible for failure to perform our obligations in case of force majeure (natural disaster, war, strike, widespread Internet outage, etc.).

12. Applicable Law and Jurisdiction

12.1 Applicable Law

These terms are governed by Swiss law. If you reside in the European Union, this choice does not deprive you of the protection afforded by the mandatory consumer-protection provisions of the law of your country of residence.

12.2 Jurisdiction

In case of dispute, we favor amicable resolution. Failing that, the competent courts are those of the Canton of Vaud, Switzerland.

In accordance with European regulations, you may use the online dispute resolution platform: https://ec.europa.eu/consumers/odr/

13. Miscellaneous Provisions

13.1 Partial Nullity

If a clause is declared null, the other provisions remain applicable.

13.2 Waiver

Failure to exercise a right does not constitute a waiver of that right.

13.3 Modifications

Any modification to these terms will be notified 30 days before its entry into force.
